1. Controller and platform

For the purposes of the EU General Data Protection Regulation (GDPR), the Italian Personal Data Protection Code (Legislative Decree 196/2003, as amended) and other applicable law, CHARIF TAKIEDDINE acts as controller for personal data processed for its own store purposes. Shopify supplies the ecommerce platform and processes data according to its role and applicable terms. 3. Sources

Information is obtained directly from the customer, automatically from use of the store, from Shopify and store applications, and from payment, fraud-prevention, delivery or customer-service providers where necessary and lawful.

4. Purposes and legal bases

Data may be processed to take steps requested before a contract and to perform orders; comply with tax, accounting, consumer, product-safety and legal obligations; pursue legitimate interests such as securing the store, preventing fraud, improving service and handling claims; and send non-essential marketing or use non-essential cookies where valid consent is required. Consent can be withdrawn at any time without affecting earlier lawful processing.

5. Disclosure

Information may be disclosed to Shopify, payment providers, carriers, fulfilment services, fraud-prevention and security providers, customer-service and communications providers, professional advisers, insurers, authorities and parties involved in a lawful business transaction. Each recipient receives only information reasonably needed for its role and must process it under applicable law.

6. International transfers

Some providers may process information outside Italy or the European Economic Area. Where required, transfers rely on an adequacy decision, approved standard contractual clauses or another lawful safeguard, together with supplementary measures where appropriate.

10. Security and children

Reasonable organizational and technical safeguards are used to protect information. No system is completely secure. Do not send passwords, complete card details or unnecessary sensitive documents through the contact form. The store is not directed to children who cannot lawfully enter an online purchase contract without required authorization.

Delivery destinations

Available destinations are shown at checkout after a complete address is entered. If a destination or delivery service is not offered at checkout, we cannot accept that delivery request through the store.

Delivery methods, charges and estimates

The available method, charge and delivery estimate are displayed before payment and confirmed with the order. We do not publish a fixed delivery promise when the required operational information has not been supplied. An estimate is not a guaranteed date unless expressly stated as such for the order.

Order processing

Processing can include payment authorization, security review, stock allocation, quality control, packing and carrier handover. If an item becomes unavailable after ordering, we will contact the customer and provide the remedies required by law.

Delivery deadline under consumer law

Where no different delivery date or period has been agreed, consumer goods must be delivered without undue delay and no later than 30 days after conclusion of the contract. If delivery is late, the consumer may grant an additional appropriate period and may terminate the contract where the legal conditions are met, including where the agreed date was essential.

Address accuracy and failed delivery

Customers must provide a complete and accurate delivery address and any information reasonably required by the carrier. Contact us promptly if a correction is needed; a parcel cannot always be redirected after fulfilment begins. Re-delivery or return costs caused by an incorrect address may be charged only where lawful and properly disclosed.

Risk, loss and damage

For consumer orders, risk generally passes when the customer or a nominated third party physically receives the goods, except where the customer independently appoints a carrier not offered by us. Report a parcel that appears lost, damaged or incorrectly delivered through the Contact Us form with the order number and supporting photographs where relevant.

Tracking and split shipments

Tracking is provided where supported by the selected service. An order may be divided into more than one parcel. The order information will identify the relevant shipment details where available.

Cross-border charges

For delivery outside the customs territory from which goods are shipped, authorities may assess import VAT, duties or handling charges. Checkout will indicate where amounts are collected in advance. We cannot undervalue goods or misdescribe the contents of a parcel.

Order and return requests

For an order-related request, include the order number, the email used at checkout and a concise description. To exercise the statutory right of withdrawal, clearly state that you are withdrawing from the contract and identify the products concerned and the date received. A reason is not required.

Currency and prices

Prices are displayed in euro (EUR). Consumer prices include VAT where applicable. Delivery charges and any other amount payable are shown before the order is submitted. A bank or wallet provider may apply its own conversion or service fee.

Available payment methods

Only the payment methods displayed in Shopify checkout are available for a particular order. Availability may depend on location, device, order value and payment-provider rules. We do not accept card details through the contact form.

Authorization and capture

A payment provider may authorize, reserve or capture funds according to the method selected. An order acknowledgement confirms receipt of the order but does not override the contract-formation rules in the Terms & Conditions.

Payment security

Checkout and payment information are handled by Shopify and the payment providers shown at checkout. Providers may use authentication, fraud screening and other security controls. We do not receive or store a complete payment-card number through the store contact form.

Failed or declined payments

A payment may fail because of incorrect details, insufficient funds, an issuer restriction, authentication failure, network interruption or security review. Customers should follow the message shown at checkout or contact their payment provider. We may cancel an order where payment is not successfully completed.

Refunds

1. Store information

The store sells casual jeans. The business name and contact details are stated above. No company registration number or VAT number is published because those details have not been supplied. Customers may also use the Contact Us form.

2. Eligibility and acceptable use

Customers must have legal capacity to enter the contract or act with the authorization required by law. The website may not be used for fraud, unlawful activity, interference with security, automated abuse, infringement of rights or resale activity that violates applicable conditions.

3. Product information

Product pages present the supplied title, description, images, options, price and availability. Customers must review the selected option before ordering. Screen settings and lighting can affect colour appearance. We may correct an obvious error before accepting an order and will provide any remedy required by law.

4. Prices and currency

Prices are displayed in euro (EUR) and include VAT where applicable. Delivery charges and the total payable are presented before order submission. A payment provider may apply charges outside our control.

5. Placing an order

An order is submitted when the customer completes checkout. The customer must provide accurate billing, delivery and contact information. An automated acknowledgement confirms receipt but does not by itself guarantee acceptance, stock or dispatch.

6. Contract formation

The sales contract is formed when we communicate acceptance or dispatch the goods, according to the order communication. We may decline an order for a lawful reason such as failed payment, unavailable stock, an obvious pricing error, suspected fraud, delivery restrictions or an unlawful request. Any captured amount for a declined order will be reversed or refunded.

7. Payment

Only payment methods shown at checkout are accepted. Payment processing, authorization, security checks and refunds are described in the Payment Policy.

8. Delivery

Available destinations, charges and estimates are shown at checkout. Delivery rights, delay remedies, risk and failed-delivery rules are described in the Shipping Policy.

9. Withdrawal and returns

Eligible consumers generally have 14 days to withdraw from an online sales contract, subject to statutory exceptions. Procedures, return costs, refunds and conformity remedies are described in the Return & Refund Policy.

10. Legal guarantee

Consumers receive the legal guarantee of conformity provided by the Italian Consumer Code. Mandatory remedies cannot be excluded or reduced by these Terms, a sale price or a commercial policy.

11. Liability

Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer, product-liability and conformity rights. Subject to that rule, responsibility is determined under applicable law and the proven circumstances. We are not responsible for an external website or service that we do not control, without prejudice to responsibility imposed on us for performing the sales contract.

12. Intellectual property

Store design, text, graphics and other protected content may not be copied, republished or commercially exploited without permission, except where law permits. Product information supplied by third parties remains subject to the rights of its lawful owner.

14. Changes

This choice does not remove mandatory protection granted by the law of a consumer's habitual residence. 14-day right of withdrawal

Subject to statutory exceptions, a consumer may withdraw from an online sales contract within 14 calendar days without giving a reason. For goods, the period generally begins when the consumer or a nominated third party other than the carrier receives the goods. Special timing rules apply to multiple goods delivered separately and goods delivered in lots.

How to exercise withdrawal

Before the period expires, send an unambiguous withdrawal notice through the Contact Us form. Identify the order, the products concerned, the date received and the email used for the order. A reason is not required.

Returning the goods

After giving notice, return the goods without undue delay and no later than 14 days after the notice. Follow the return instructions provided for the order. Do not send a parcel to an unconfirmed address. The consumer is responsible only for any diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Return costs

For an ordinary change-of-mind withdrawal, the consumer bears the direct return cost where that obligation was properly disclosed and applicable law permits. We bear the appropriate cost where goods are non-conforming, defective, damaged before risk passed or incorrectly supplied.

Refund timing and method

Where withdrawal is valid, payments received for the relevant goods, including the cost of the least expensive standard delivery offered for the order, are reimbursed within 14 days after we are informed of the decision to withdraw. We may withhold reimbursement until the goods are received or the consumer supplies evidence of return, whichever occurs first. Refunds use the original payment method unless another method is expressly agreed without cost to the consumer.

Statutory exceptions

The right of withdrawal does not apply where an exception under Article 59 of the Italian Consumer Code applies, including goods made to the consumer's specifications or clearly personalised. An exception is applied only where its legal conditions are met and does not remove rights relating to non-conforming goods.

Legal guarantee of conformity

The seller is responsible for a lack of conformity existing at delivery under the Italian Consumer Code. Depending on the circumstances and statutory conditions, the consumer may be entitled to repair or replacement without charge, or to an appropriate price reduction or termination of the contract. These rights are independent of the withdrawal right and any commercial return offer.

Wrong, damaged or defective goods

Contact us promptly with the order number, a description and clear photographs where helpful. Do not continue using or alter goods where doing so could worsen damage or make inspection impossible. Nothing in this policy limits a mandatory remedy.

Exchanges

An exchange is available only where expressly offered and stock permits. Otherwise, an eligible product may be returned and a new order placed. This does not affect the statutory remedy of replacement for non-conforming goods.

Complaints

If a return decision is disputed, use the Contact Us form and provide the relevant documents and requested resolution. Consumers retain access to competent courts and any applicable alternative dispute-resolution route.
